Courts May Award Attorney Fees For These Reasons

In California, family law courts may also require one party to pay attorney fees in these circumstances:

  • To address financial need. If one party earns less than the other, the spouse with the higher income may be ordered to cover the other party’s legal fees.
  • To penalize the spouse who fails to follow a court order or provide required documents
  • To penalize the party that fails to act in good faith during proceedings
